Lil Mosey is set to stand trial on charges of second-degree rape. However, Lil Mosey feels there is evidence that will help his defense and argues for admissibility.
The Premise
This case stems from an incident in January when a young woman claims the defendant raped her. The victim allegedly suffers from multiple physical injuries. However, that wasn’t the only disturbing factor. According to a source, in an affidavit, the woman in question admitted to receiving a shocking text.
She claims she got a message from someone at a party saying the guys were talking about “training two girls.”
If true, that is a severe implication.
What is Lil Mosey’s New Evidence?
According to TMZ, Lil Mosey claims the alleged victim once made an admission to having consensual sex with him. However, that was in the past. So how is this argument relevant, and why does Lil Mosey want to include this argument?
According to the artist,
a prior consensual sexual relationship should be admitted because it helps him defend against the allegation she did not consent.
Does it work that way?
The prosecution team is arguing the contrary and stands firmly against the admission of the evidence. As TMZ notes, in new legal documents, the alleged victim’s prior sexual activity is irrelevant to whether she consented.
Breaking Down the Flaw in Lil Mosey’s Argument.
No matter how many times an individual consents to intercourse in the past, it does not impact an individual’s right to withdraw consent at any given moment in the future. Yet, Lil Mosey believes his argument has relevancy.
So What is the Foundation of This Argument Exactly?
TMZ states that the rapper claims he met the alleged victim back in the day at one of his concerts, and they eventually engaged in consensual sexual activity…multiple times.
Why is There a Question of Relevancy?
The victim is not arguing alleged rape for all those encounters. Instead, she is alleging later, at a cabin, she was raped. Thus, Lil Mosey is on trial for the one incident. Unfortunately, the flaw in the argument is not the only thing standing in the way of Lil Mosey’s defense.
What Are the Other Factors Standing in Lil Mosey’s way?
The state wherein he is being tried has a statute preventing the admissibility of the evidence the artist is requesting.
As TMZ indicates,
In Washington, a “rape shield” statute generally prohibits evidence of prior sexual relationships and activities with an alleged victim at trial.
Given the legality of permitting such evidence in a Washington court, it’s not likely the court will recognize his plea. Sadly, if found guilty, he stands to serve life. Unfortunate as this may be, his legal team will have to find another defensive strategy if denied the admission.
